Abstract
Uno de los graves problemas de la burocracia castellana a lo largo del Medievo y la
Modernidad deriva directamente de la conculcación del principio de preeminencia del
oficio respecto al titular, lacra que acabaría afectando a la totalidad de su funcionariado. La
administración de justicia tampoco se vio libre de tan importante deficiencia, y dentro de ella
la actividad procuradora resultaría una de las más perjudicadas. La gravedad de la situación se
acentúa, pese a los continuos esfuerzos normativos, ante la elevada dependencia de la misma
por parte de una población con elevados índices de analfabetismo y enfrentada a una compleja
estructura judicial. Desde los primeros ordenamientos reguladores de la representación jurídica
se advierte la preocupación por frenar y subsanar dicha realidad con la puntual determinación
de los requisitos que debían acompañar al podatario.
One of the serious problems of the Castilian bureaucracy along the medieval and moder times directly derives from the breaking of the principle of preeminence of office respect to holder, damages that it would end up affecting the totality of the government employees. The justice administration didn’t see itself either free of so important deficiency, and the activity of the attorney would be one from the most harmed. The importance of the situation is accentuated, in spite of the continuous normative efforts, because of the high dependency on it for a part of the population with high levels of illiteracy and that has to face a complex judicial structure. From the first regulations of the legal representation the preoccupation is noticed to restrain and to correct this reality with the precise determination of the requirements that had to accompany the procurator.
