La religiosidad popular más allá de la muerte : los testamentos de los escribanos malagueños del siglo XVII

Abstract

Las escrituras de testamento constituyen la manifestación de la última voluntad de una persona, en las que intentan dejar solucionados sus asuntos espirituales y terrenales. Los testadores, a través de sus invocaciones nos van ofreciendo un reflejo de su religiosidad a la vez que nos brindan una serie de pautas de los comportamientos del fervor popular de la sociedad en la que viven. Es posible observar cuestiones tan íntimas y personales como las creencias religiosas a pesar de que las disposiciones testamentarias contengan toda una serie de cláusulas propias del lenguaje notarial. En este artículo nos acercaremos a las cuestiones planteadas tomando como centro de nuestro estudio los documentos de final voluntad custodiados en el Archivo Histórico Provincial de Málaga y redactados por los escribanos públicos malagueños del siglo XVII, pues en ellos se aúna una doble condición: el individuo con sentimientos y creencias propias y el profesional habituado a las fórmulas notariales.Testaments constitute the last will of a person. The testament means the desire of having solved the most of the spiritual and earthly matters as can be the inheritance of a person. The testators, with his several petitions, offers us proofs of his religious beliefs, what make us understand the guidelines of behaviors of the society at that time. It´s possible to find or discover private and personal desires in testaments using a legal language. We are going to approach to the main issues in this article, taking as the center of our research different written texts of last will, which are guarded by the Historical Archives of Malaga. These legal testaments which were made by notaries of this city during the 17th century join a double condition: the beliefs and feelings of the human being and the legal knowledges used in the testamental forms.
