Supuestos españoles y británicos en materia de tortura y tratos degradantes ante el tedh en la última década

Abstract

En esta investigación se pretende conocer las características de los sujetos españoles y británicos que reclaman respuesta ante el Tribunal Europeo de Derechos Humanos (TEDH) por entender que han sido torturados o tratados degradantemente, es decir, por posible vulneración del artículo 3 del Convenio Europeo de Derechos Humanos (CEDH). Una visión criminológica debe apostar por escuchar los problemas a los que se ven abocados algunos sujetos que, habiendo agotado las instancias judiciales nacionales, entienden que su voz ha de ser oída por instituciones internacionales. De hecho la muestra seleccionada incorpora supuestos de vulneración y supuestos de mera admisibilidad. This research aims to know the characteristics of the Spanish and British subjects who demand a response before the European Court of Human Rights (ECHR) because they understand that they have been tortured or treated degradingly, that is, due to possible violation of article 3 of the European Convention on Human Rights (ECHR). A criminological vision must bet on listening to the problems faced by some subjects who, having exhausted the national judicial instances, understand that their voice must be heard by international institutions. In fact, the selected sample incorporates cases of violation and cases of mere admissibility. In this study, a jurisprudential analysis is carried out with standardized ad hoc collection templates, which allows, on the one hand, to assess the casuistry and, on the other, to have a uniform element that allows comparison.
