Abstract

Access to land is one of the biggest problems faced by farmers when they want to enter this sector. Hence the importance of analysing this issue in order to adopt appropriate measures to facilitate access. Among all these measures, this paper addresses the issue of access to land from a regulatory perspective, analysing the regulation of the various legal instruments in Spanish law that allow access to land, whether under a regime of ownership or individual or shared use. The classic mechanisms for access to land are analysed, as well as new models of access that are being implemented very successfully in some Autonomous Communities. In turn, proposals are made to improve this regulation in order to facilitate access to land and its mobilisation, as well as the consolidation of existing agricultural holdings. Furthermore, the generational renewal policies that Spain is implementing in this area are presented and analysed, and some measures are proposed that we believe could facilitate access to land for young farmers.
